Can the Belgian consulate conduct the marriage?

Belgian career consulates do not solemnise marriages. For a marriage abroad, obtain the document list from the foreign authority that will conduct it. If it requires a certificate of no impediment, a Belgian applicant requests it from the Belgian career consulate competent for that country. This pre-marriage process is distinct from registering an existing marriage certificate.

Recognised certificate and BAEC/DABS: which municipality is responsible?

For recognition in Belgium, a foreign marriage must meet each spouse’s national-law substantive requirements and the formal requirements of the country of celebration. The recognised certificate can then be registered in BAEC/DABS through the municipality of registration, failing that the last municipality of registration, or otherwise Brussels. Translation or an apostille alone therefore does not establish recognition.

Does an EU marriage certificate need an apostille?

A public marriage certificate circulated between authorities in two EU countries within Regulation 2016/1191 is exempt from apostille. An attached multilingual standard form may avoid translation. Recognition of the marriage itself remains a separate question; ask the recipient whether the certificate and form are sufficient.
